Genau so wird es sein. Nach meiner Kenntnis geht es allein um Markenrechte. Aus der Entscheidung der EUIPO (Zweite Beschwerdekammer) vom 08.03.2018 - R 415/2017-2:
By an application filed on 16 June 2010, Gibson Guitar Corp. (‘the EUTM proprietor’) sought to register the 3D mark

On 13 September 2013, the Office registered the EUTM proprietor’s change of name to ‘Gibson Brands, Inc.’
On 7 October 2014, Hans-Peter Wilfer (‘the cancellation applicant’) filed a request for a declaration of invalidity of the registered mark for part of the goods and services, namely:
Class 15 - Musical instruments.
Kurz gesagt, Gibson wollte das Shaping der Flying V als 3D Marke schützen lassen, wie es z.B. Haribo mit dem Goldbären getan hat, Toblerone, Colaflasche usw.:
